Terms of service

These Terms of Service (the "Terms") set out the conditions for using the online store of has GROWN bike ("we" or "us"), operated by YKファミリー株式会社 (https://shop.hasgrown.com and other sales sites we operate; the "Store"). When you order from the Store, these Terms form part of your contract with us.

Article 1 (Scope)

  1. These Terms apply to all dealings between you and us relating to the Store, including browsing the Store and purchasing products.
  2. The Shipping Policy, Refund Policy, Privacy Policy and Legal Notice posted on the Store (the "Policies") form part of these Terms. If these Terms and a Policy differ, the Policy prevails.

Article 2 (Accounts)

  1. If you create an account on the Store, please register accurate information.
  2. You are responsible for managing the email address and other details you use to log in. If you notice unauthorized use by a third party, please contact us promptly.

Article 3 (Orders and formation of contract)

  1. A sales contract is formed when you complete checkout on the Store and we send you an order confirmation email.
  2. Even after a contract is formed, we may cancel an order in any of the following cases. In that case, we will refund the full amount paid.
    1. We cannot supply the item, for example because it was sold in our shop at the same time
    2. There was an obvious error in the price or other information shown
    3. We judge the order to be fraudulent, for example because it contains false information
    4. We cannot deliver the item for other unavoidable reasons

Article 4 (Prices and payment)

  1. Prices are shown on each product page, including consumption tax. Shipping and other charges are as set out in the Shipping Policy and the Legal Notice.
  2. Payment methods and timing are as set out in the Legal Notice.
  3. For international orders, import duties and taxes are paid by the buyer.

Article 5 (Shipping)

  1. Shipping methods, rates and timing are as set out in the Shipping Policy.
  2. If an item is returned to us because you were absent, the address was wrong or for similar reasons, you pay the shipping for re-delivery.

Article 6 (Returns, exchanges and cancellations)

Returns, exchanges and cancellations are governed by the Refund Policy.

Article 7 (Using bicycles and parts)

  1. Bicycles sent by bicycle courier are delivered with some parts removed for shipping. If you are unsure about assembly or adjustment, have the bicycle checked at a bicycle shop before riding, or contact us.
  2. Installing parts requires checking compatibility and the right tools and knowledge. If you are unsure about compatibility, please ask us before ordering.
  3. We are not responsible for problems or damage caused by your own assembly, installation, adjustment or modification, unless caused by our intent or negligence.

Article 8 (Made-to-order and custom items)

  1. We make made-to-order and custom items after you confirm the specifications, price and delivery time.
  2. Because of handwork and the nature of the materials, color, texture and other details may vary from item to item.

Article 9 (Prohibited conduct)

When using the Store, you must not:

  1. Act in violation of laws or public order and morals
  2. Register or send false information
  3. Interfere with the operation of the Store, or access or attempt to access it without authorization
  4. Infringe the rights or interests of us or any third party

Article 10 (Intellectual property)

Rights in the text, photos, images, logos and designs on the Store, and in the designs of products we design and make, belong to us or the rightful owners. You may not copy, republish, modify or sell them without permission beyond private use.

Article 11 (Disclaimers and limitation of liability)

  1. Colors and other details may look different from the actual item depending on your viewing environment.
  2. We may suspend all or part of the Store without notice for system maintenance or failures, natural disasters or other unavoidable reasons.
  3. If you suffer damage due to our breach of contract or tort, our liability is limited to the price of the order concerned, unless we acted intentionally or with gross negligence. This limit does not apply to injury to life or body.

Article 12 (Personal information)

We handle your personal information in accordance with our Privacy Policy.

Article 13 (Minors)

If you are a minor, please use the Store with the consent of a parent or other legal guardian.

Article 14 (Changes to these Terms)

  1. We may change these Terms in accordance with Article 548-4 of the Civil Code of Japan.
  2. When we do, we will post the changed Terms and their effective date on the Store before the effective date. Orders placed on or after the effective date are subject to the changed Terms.

Article 15 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the use of the Store is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, if you are a consumer, this does not deprive you of the protection of the mandatory provisions of the laws of your country or region, or of your right to bring proceedings in a court that is competent under the law.
